These terms are between you (the business signing up) and Till Worx ("we"), for the use of TillWorx.
We provide your ordering website, admin screen, kitchen screen, till program and related features, hosted by us, for as long as your subscription is paid.
The software behind the service (the website, screens, till program, phone app, their code and design) belongs to us. You get a licence to use it to run your own business while your subscription is paid; it isn't sold to you, and the licence ends when your subscription does.
You must not, or let anyone else: copy, download in bulk or re-host the software or its design; take it apart, decompile or reverse-engineer it, or try to get at its source code, except where the law gives you a right to that can't be excluded; get round its licence checks or security; use automated tools to copy our websites; or use it, or anything learned from it, to build or help build a competing product. Your own content (menu, photos, logo, text) stays yours.
If you break this, we may suspend or end your account straight away, and we may take legal action to protect our rights. The software contains hidden markers so copies can be traced back to where they came from.
Plans are paid monthly or for 12 months in advance, by card, through Stripe. Free trials end on the date shown when you sign up, and your plan then starts automatically unless you cancel first. Monthly plans can be cancelled at any time and run to the end of the period already paid. 12-month plans are not refundable part-way through.
If a payment fails, we'll warn you on your staff screens. If it is still unpaid after 21 days, admin changes and online ordering are paused; after 28 days the till is paused too. Everything turns back on when you pay.
Your menu, orders and customers' details are yours. We process customers' details on your behalf only to run the service (see the privacy notice), and you can download them at any time. You are responsible for your own allergen information, prices, food safety and your customers.
You choose how you take them. Through us: your customers' payments go to your own Stripe account, connected to ours, under Stripe's terms (including the Stripe Connected Account Agreement). Stripe charges its own fees to you, and we add a fee of 1% per card payment, which Stripe takes automatically and pays to us; it is given back, in proportion, if you refund the payment. We may change this fee with 30 days' notice by email. Refunds and chargebacks come from your Stripe balance. Your own Stripe account: payments go to it under Stripe's terms, and we take nothing on them. We never take a commission on your orders.
We aim to keep the service running at all times and back it up every night, but can't promise it will never be interrupted. Our liability is limited to the subscription fees you paid us in the 12 months before the problem, except where the law doesn't allow this.
We may update these terms and prices with 30 days' notice by email.
These are standard terms to be checked by your own adviser before you rely on them.
